The eThekwini Municipality warned not to evict residents in Clermont without a court order
Abahlali baseMjondolo, represented by the Socio Economic Rights Institute of South Africa, approached the Durban High Court on an urgent basis this morning. This follows several illegal and violent evictions carried out by eThekwini’s Anti Land Invasion Unit against several communities in Durban, including in C Section in Clermont.
The matter was adjourned to Friday next week, giving the Municipality the opportunity to file papers. However, the judge, Mahendra Chetty, issued a strong warning that the Municipality must not evict the residents of Clermont.
Abahlali is seeking an order that prohibits the municipality from demolishing and evicting poor residents of Clermont.
We are happy that while the matter is waiting to be finalised, the court has warned the municipality that it has acted in full violation of the law. We want to make it very clear that should the municipality continue to act in full violation of the court order, as they have done before, we will not hesitate to resist their actions and to return to court on an urgent basis.
