DA MEC Bonginkosi Madikizela threatens to demolish more houses in Mandela Park

Mandela Park Backyarders Press Release and Invite
25 February 2011

MEC for Human Settlement in the Western Cape is set to come and demolish more brick houses in Mandela Park between Monday and Tuesday next week. The news were leaked to us by a supervisor on site after a secret meeting with the MEC that was to address the resuscitation of housing construction in Mandela Park.

We vow to stay away from work and protest during these two days in preparation of what we perceive as housing warfare between state and its community. The 2 recent government projects named “823” and “497” were completed in 2008 despite delays due to money laundering and corruption by government and party officials. The claimed continuation of the current housing projects in Mandela Park is the MEC’s gimmick to lobby voters for the coming local municipality elections. There is a huge maladministration and poor conduct in the current housing construction and the police are used to distabilise & arrest any one trying to expose the corruption.

As backyarders we view the destruction of our houses as act of desperation by the City of Cape Town to maintain political hegemony.

The sad memories of what happened in Zimbabwe will soon be happening in the City of Cape Town, where the legacy of apartheid and inequality is sustained.

We call all civil organisations, journalists and supporters to come and witness the destruction of our homes and life savings in Mandela Park on Monday 28th of February or Tuesday the 1st of March (call us to confirm the day).

We also want to remind journalists that the DA branch chairperson, Mr. Molly Mxolisi will be appearing in Khayelitsha Magistrates Court on the 1st of March for attempted murder of Backyarder member. As we have shown in the past, this case involves illegal interference by MEC for housing Bonginkosi Madikizela in the judicial process.

It is possible that the planned destruction of houses by the MEC is linked with his efforts of trying to divert attention from Mr. Molly’s attempt murder case which is taking place on Tuesday. According to the prosecutor in charge, Mr. Molly Mxolisi is likely to have some charges reinstated (after Madikizela had the charge sheet changed to common assault).

We forward this invitation to all journalists, civil organisations and supporters to come and witness one of the most brutal Ministers for Housing in post-1994 South Africa.

Abahlali baseMjondolo of the Western Cape Rejects DA Hypocrisy and Stands Firm for Press Freedom

As a movement we have become used to the blatant hypocrisy of the DA over the years.

The DA says that it wants to crack down on crime and support the rule of law but then it engages in unlawful and criminal evictions, as in Macassar Village in 2009. In South African law any eviction without a court order is an unlawful and criminal act and yet the DA began to demolish shacks in Macassar Village without a court order on 21 May 2009. We went to court to secure an urgent interdict to stop the DA from engaging in these criminal attacks on the poor and we won that interdict and yet you then went ahead and demolished shacks in violation of that court order. The criminality of your municipal government here in Cape Town was condemned by local church leaders and international human rights organisations.

City Press: FXI opposes DA’s blacklisting of journalist

FXI opposes DA’s blacklisting of journalist

The Democratic Alliance’s (DA) blacklisting of a Sowetan journalist is “outrageous”, the Freedom of Expression Institute (FXI) said today.

“It is outrageous that the DA is itself blacklisting journalists when it was so opposed to Snuki Zikalala doing the same at the SABC and has been so vocal about the ANC’s approach to the media,” said spokesperson Jayshree Pather.

The DA blacklisted the Sowetan’s Cape political correspondent Anna Majavu, a former spokesperson for the SA Municipal Workers Union, in August last year because she has a “political agenda”.

“FXI’s view is that it is the prerogative of editors and not political parties to appoint journalists and judge their capacity and performance. Journalists must be judged by their adherence to agreed editorial standards and not by their previous positions.”

The FXI added it’s voice to other groups such as the SA National Editors Forum and the SA Municipal Workers’ Union opposing the blacklisting of journalists.

The DA’s executive director of communications and research Ross van der Linde confirmed to the Sowetan yesterday that the party had cut communication with Majavu.

“Majavu is not a journalist. Some journalists and editors disagree with our policies and views, and they are entitled to do so. But Anna Majavu is a former South African Municipal Workers Union spin doctor, who has a particular political agenda,” Van der Linde said.

He said the DA was not obliged to send information to any individual or organisation.

Majavu said her woes with the party started when she wrote a story about how DA MP Pieter van Dalen allegedly shot at two children in Khayelitsha.

The Sowetan said Majavu based her story on a report by Advocate Pierre van Tonder, who adjudicated in the matter of an appeal by a Metro police officer who was dismissed.

“The officer, with Van Dalen, shot rubber bullets at two children playing soccer in Khayelitsha late at night,” the Sowetan said.

Van Dalen – who was a councillor at the time of the incident – accompanied metro police officers during the xenophobic attacks in 2008.

IOL: Media slam DA’s Majavu blacklisting

For the DA a journalist that takes the lives of poor people seriously is automatically biased. They are now exposed for their authoritarianism and bias to the middle classes.

Media slam DA’s Majavu blacklisting

The DA’s blacklisting of a Sowetan journalist sets a “problematic precedent”, says Jane Duncan, professor and chairwoman of the Media and Information Society at Rhodes University.

It was of concern if any political party that carried public power took a step to stem the flow of information in this way, she said on Thursday.

“If they have concerns, they are not dealing with the problem by refusing to provide information to that journalist. They should continue to take the concerns to the Press Ombudsman to establish systematic bias,” Duncan said.

“If the journalist is biased, it will come out in the wash.”

DA executive director of communications and research Ross van der Linde is quoted in Thursday’s Sowetan as confirming the party had cut all communication with Anna Majavu, adding it was not obliged to send information to any individual or organisation.

“Majavu is not a journalist. Some journalists and editors disagree with our policies and views, and they are entitled to do so. But Anna Majavu is a former South African Municipal Workers’ Union (Samwu) spin doctor, who has a particular political agenda,” he said.

The DA’s decision followed a complaint to the press ombudsman over a story which linked one of its MPs, and two metro police officers, to the shooting with rubber bullets of two children in Khayelitsha. The story was based on the outcome of an arbitration process.

In September, the press ombudsman directed the Sowetan to publish a correction of a sentence that incorrectly attributed a statement to the arbitrator, as well as a summary of the ruling. The newspaper was also reprimanded for a misleading headline.

The DA’s communication director, Gareth van Onselen, said on Thursday the newspaper had “failed properly to comply”, adding the DA had a long and detailed record of bias on the part of Majavu.

“There is no point in working with a journalist who is not interested in reporting the news,” he said.

Duncan disagreed and pointed out that the DA had been vocal in support of media self-regulation and freedom of expression. Cutting off communication was “completely inappropriate” and sent the message that the DA would only deal with journalists who gave it positive coverage.

The South African National Editors’ Forum (Sanef) said it was “deeply perturbed” by the reported blacklisting of Majavu. It said the move “flies in the face of the DA’s founding liberal values, including commitment to press freedom”.

Calling into question Majavu’s credibility as a journalist simply because she had worked for a trade union was “preposterous”.

Sanef called on the DA to rethink its position and lift the ban.

Meanwhile, the labour sector has come out in support of Majavu. Both the National Union of Metalworkers of South Africa and Samwu condemned the DA’s “dastardly censorship” and “immature behaviour”. – Cape Times

DLF Statement on Mandela Park Evictions and Arrests

Democratic Left Front (Western Cape): Press release on eviction and arrests in Mandela Park, Khayelitsha, 7/2/2011

The Democratic Left Front condemns unreservedly the action of the Western Cape “Democratic Alliance” government and the branch of the Democratic Alliance in Mandela Park, Khayelitsha.

Around 09h30 on Friday 4th February, the Western Cape MEC for Housing Bonginkosi Madikizela, came with police and the Anti-Land Invasions Unit to Mandela Park. They came without warning, without the necessary court documents, and destroyed 9 brick houses and shacks in sections 20-21 of Mandela Park.

The said reason for the demolition was that the land was owned by the government. But this land was unused and unoccupied and there were no plans to do anything with it. It should be the right of homeless and poor residents to uplift themselves by building their own houses on the land. Moreover, many of the houses were occupied and therefore the eviction without a court order was a criminal contravention of the Prevention of Illegal Evictions Act.

Residents naturally protested. In the course of the protest two persons, Mr. Solomon and Mr. Yanga were shot at by local DA branch chairperson, Mr. Mxolisi Molly. Molly also smashed Mr. Solomon over the head with his gun and beat him to a pulp. When police arrived at the scene, Molly was taken into custody and charged with attempted murder (case# 784/02/2011). But two hours later, after the intervention of Madikizela, Molly was released and the charge was changed to assault.

The following day, Saturday, Mandela Park residents sought to lay a complaint for this outrageous behaviour. But instead of re-opening the charges against the DA, or opening a case against Madikizela for the unlawful and criminal destruction of Mandela Park homes, the police arrested four residents of Mandela Park on charges of assault! These residents were released on bail yesterday and will now appear in the Khayelitsha Magistrate’s Court tomorrow morning (Tuesday) at 10am. They still do not have legal representation.

These action are illegal and an attack on homeless people.

The Democratic Left Front (Western Cape) calls on all progressive organizations throughout Cape Town to support the four Mandela Park residents when they appear in court tomorrow. The DLF supports the decision of Mandela Park residents to fill the court in protest against the actions of the Khayelitsha SAPS, the DA and MEC Madikazela.

The DLF demands:

1. The immediate dropping of charges and release of the four Mandela Park residents.

2. The reinstatement of charges of attempted murder against Mxolisi Molly.

3. The arrest of Bonginkosi Madikazela on charges of violation of the PIE Act.

4. The immediate reconstruction of the demolished houses at the expense of the state.

5. The provision of temporary accommodation for the affected residents.
