Mpisane wins tenders worth R455m – despite conviction

Controversial businessperson Shaun Mpisane has been awarded tenders worth R455-million after a settlement that allowed her to bypass normal processes.

According to the Mercury on Monday, a report tabled recently before the finance and procurement committee revealed Mpisane’s company Zikhulise Cleaning, Maintenance and Transport was awarded three section 36 contracts between July last year and March this year relating to an Umlazi housing project.

Ethekwini municipality treasurer Krish Kumar said the contracts were as a result of an out-of-court settlement the city had with Zikhulise.

Mpisane took the city to court claiming that the project was stalled by city officials who questioned whether it should do business with a convicted person.

Mpisane has a 2005 conviction for VAT fraud.

The settlement allowed Mpisane to continue with the project, including new phases of construction.

Facing 53 charges of fraud
Kumar said the city was entitled to award the contracts, as Zikhulise was the original contractor and a decision was taken that it was appropriate for the company to continue with the project.

In May, Mpisane will stand trial for allegedly inflating invoices by more than R5-million to cut her tax bill.

She also faces 53 charges of fraud, forgery and uttering.

Shawn, one half of the controversial Mpisane couple, is accused of submitting false documents to obtain Construction Industry Development Board gradings, which were then used to obtain public works department tenders worth R140-million.

In February, Mpisane was arrested on allegations of fraud as the National Prosecuting Authority searched for assets worth R140-million.

The NPA at the time said luxury cars valued at around R22-million were seized from former Durban metro police officer Sibusiso Mpisane and his wife.

The cars included a Rolls-Royce Phantom, a Rolls-Royce Ghost, a Maserati, a Ferrari Scaglietti, a Porsche Cayenne Turbo and a Panamera Turbo, two armoured BMW 5 Series and two Hummers, the authority said in February.

In another case she is also charged with corruption for allegedly trying to persuade a state witness in one of her tax fraud cases to tamper with evidence. – Sapa

Andile Mngxitama and Athi Joja have every right to criticise Jared Sacks for his piece on Mamphele ­Ramphele and Steve Biko (“Biko would not vote for Ramphele”, March 15), but it is downright unethical for ­Mngxitama to threaten Sacks with violence – and to incite Sacks to resort to violence too – because Mngxitama did not like what he wrote.

According to a post on Mngxitama’s Facebook page: “real bikoists out there, whenever we see that white little bastard called jared sacks, we must beat the shit out of him. they now pissing on biko’s face. they can diss mamphele all they want, but to insult us like this? when i see jared, he must beat me up. that’s the deal.” He also responded to a response on his page by saying: “jared will pay for this.”

We accept that it is in the nature of Facebook for people to express themselves bluntly as it is not a completely public forum. But there must be accountability for what one says, even on Facebook, particularly if one is a public figure. People often “friend” people such as Mngxitama because of their public profile. To settle a political dispute through a physical fight, which is what Mngxitama calls for on his page (accessible to more than 5000 people) is a terrible message for a public intellectual of Mngxitama’s stature to communicate.

There is already too much violence in our politics. Public intellectuals have a responsibility to denounce violence as a method of resolving political disagreements, not ­encourage it.

Such threats can be profoundly intimidating to the person they are directed against. Even if they are not meant literally, others may take them so. They also have implications for the Mail & Guardian and freedom of expression more broadly, because people who approach the paper to publish their articles may be put off if they fear being subjected to similar threats.

Anyone who wishes to put their views into the public domain should accept that others may disagree, at times fiercely, but they should not fear for their safety when they do so. This will lead to self-censorship.

Mngxitama comes across as a bully who can win arguments only by policing the boundaries of the discourse on black consciousness through intimidation, rather than robust argument. Influential KwaZulu-Natal politicians have been implicated in a probe into election irregularities by Nkosazana Dlamini-Zuma.

Powerbrokers in influential ANC regions in KwaZulu-Natal are likely to face the chop as councillors if the recommendations of the report compiled by current African Union chairperson Nkosazana Dlamini-Zuma are acted upon.

Dlamini-Zuma’s report was initiated by ANC President Jacob Zuma to investigate allegations of irregularities in the list processes for councillors leading up to 2011 local-government elections. The ANC had opened up nominations to broader communities, rather than just party members, for the first time.  Continue reading

Mpisane wife arrested in hunt for the duo’s R140m assets

Shawn Mpisane, one half of the controversial Mpisane couple, has been arrested on allegations of fraud as NPA search for assets worth R140-million.

According to IOL, the Durban businessperson was arrested on Thursday and is expected to appear in the Commercial Crimes Court.

On Tuesday, the KwaZulu-Natal High Court granted the Asset Forfeiture Unit an order authorising it to freeze and seize R140-million in property.

The National Prosecuting Authority on Wednesday said luxury cars valued at around R22-million were seized from former Durban metro police officer Sibusiso Mpisane and his wife.

The cars included a Rolls-Royce Phantom, a Rolls-Royce Ghost, a Maserati, a Ferrari Scaglietti, a Porsche Cayenne Turbo and a Panamera Turbo, two armoured BMW 5 Series and two Hummers, the NPA said in a statement on Wednesday.

Various construction vehicles seized were valued at about R4.5-million.

Four fixed properties – including Mpisane’s home – valued at about R25-million were also seized.

The NPA said other assets were still being identified.

Inflating invoices

Shawn, who has been convicted of tax fraud, is on trial in the Durban Regional Court for alleged tax evasion.

She is accused of, among other things, inflating invoices by more than R5-million to cut her tax bill. She has pleaded not guilty.

“Since she [Shawn] is married in community of property to her husband, it includes all property owned by the couple,” the NPA said.

“This is one of the largest cases ever done by the Asset Forfeiture Unit, and is a significant blow in the fight against corruption.”

Past scandals

In 2011 the Mail & Guardian reported that Mpisane claimed her company had received no money from the municipality since October 2009. But records showed that more than R50-million was transferred electronically from the eThekwini municipality to Zikhulise in November and December 2009, weeks before the Mpisanes hosted a glitzy New Year’s Eve bash.

The Mpisanes made headlines again when they splurged almost R1-million on birthday and wedding celebrations in a single weekend. Shawn presented her husband with a white R1.8-million Maserati GranCabrio at his 40th birthday party at their La Lucia home.

Earlier that day the couple renewed their wedding vows at the five-star Fairmont Hotel and Resort in Zimbali. The 180 guests included Khulubuse Zuma, billionaire businessman Vivian Reddy and businessperson Kenny Kunene.

Oysters, sushi, champagne and three different types of French cognac were on the menu. The flowers alone reportedly cost R300 000. “We are a couple who like class,” Sibusiso told journalists. – Additional reporting by Sapa
